ELECTION OF A COMMITTEE

  • Can the President of a community select his own committee members or do the community of owners have a vote? (I have got Horizontal Property Law but it's very long winded) and I just thought someone out there may know the answer in simple terms.

  • The President can not do what he likes, dont forget he can be voted in our out at every AGM or if you dont like what he is doing you could call an EGM the owners have the right to do this but you need to get them to agree.

  • Thanks for the reply (yes I know all of that) my question was do with the election of a committee member - and it's not as easy as you suggest getting rid of a president, but lets not go down that route :) I just want to know if the Pres has final say on who is on a committee, basically I am being told the Pres is going to select the next member (as there is a vacancy) and that it will be HIS sole descision.

    It would appear you have a President very much like ours, in fact ours is Illegal he does not even own a property on our complex but miss guided owners vote him in at our AGMs.

    May I suggest you you ask Janet Anscombe on her site I have found her very reliable in the past

  • Thanks unhappy, I'm assuming you have tried all the usual steps, going legal, trying to get other owners to elect a new pres etc etc. It's a minefield, especially for new owners who are not used to these 'ways' but you live & learn :).  I see no-one has answered my committe member question, might be too in-depth, guess I will have to read my Horizontal Law :(

  • I would have thought that your member would be proposed and seconded and then voted for at your AGM. I believe that the president would have to accepy the wishes of the majority.

    I think you are correct but some Presidents act like the complex agents ( little Hitlers ) comes to mind

  • Yes 'unhappy' is 100% correct, what the majority want in our complex doesnt seem to come into his equation !! if he no like it, it's not getting in !! end of. We have even had very important things passed & voted by majority at our AGM but we are still waiting for these 'things' to put in place. It seems we are not the only community with these type of issues as the more I delve into it the more I unearth of unhappy owners unable to oust their presidents. It would take me FOREVER to list, so best not to get too bogged down in it

  • tlc you sound very unhappy about this however you need to get someone willing to stand for President get them proposed and seconded with your administrator and them work on your residents to vote him out.The hardest part is getting over the apathy of your residents ,if they cannot attend get them to sign proxy votes,  it will not be easy however it is possible if you work at it. Do not under estimate the power of the residents majority. Good luck.
